Freedom of Information Law

The Freedom of Information Law (FOIL) grants members of the public access to the records of the District in accordance with its provisions. Public records will be made available for in person inspection and copying, by appointment, in the District Office through the Records Access Officer or designee. Record requests may also be submitted by email (see procedures below)

The Freedom of Information Law is contained in the Public Officers Law at §§84-89 and its implementing Regulations are contained  in 21 New York Code of Rules and Regulations at Part 1400.

 

Procedures:

  1. Requests to inspect or secure copies of records will be submitted in writing, either in person, by mail, facsimile, or via e-mail, to the Records Access Officer. Forms are provided and accessible through this website for written and e-mail requests, but are not required..
  2. All requests for information will be responded to within five (5) business days of receipt of the request. If the request cannot be fulfilled within five business days, the Records Access Officer will acknowledge receipt of the request and provide the approximate date when the request will be granted or denied.
  3. If the request cannot be granted within twenty (20) business days from the date of acknowledgement of the request, the district will state in writing both the reason the request cannot be granted within  twenty (20) business days, and a date certain within a reasonable period when it will be granted, depending on the circumstances of the request.
  4. Denial of Access: When a request for access to a public record is denied, the Records Access Officer will indicate in writing the reasons for such denial, and the right to appeal. If the Records Access Officer fails to respond to a request for records within five (5) business days of the receipt, or within twenty (20) business days or other reasonable time frame provided after the date of acknowledgment of receipt of a written request, such failure will be deemed a denial of access that may be appealed.
  5. Appeal: An applicant denied access to a public record may file an appeal by delivering a copy of the request and a copy of the denial to the Records Appeal Officer within thirty (30) days after the denial from which such appeal is taken.
  6. The applicant and the New York State Committee on Open Government will be informed of the Records Appeal Officer’s determination in writing within ten (10) business days or receipt of an appeal. The Records Appeal Officer will transmit to the Committee on Open Government photocopies of all appeals and determinations.
